Are there any other issues that a foreign company that has a business presence in Vietnam should know?

  1. Enforcement of IP Law in Vietnam is not efficient enough and it is a costly and very time-consuming process. There are many Offices (Customs Office, Economic Police, Bureau of Market management, Inspectors in Ministry of Science and Technology, People’s Committees) which are authorized to enforce IP rights in Vietnam and therefore there is an exiting overlap and not efficient in operation.
  2. Sometimes, there is a conflict among laws and not unity in understanding of laws among the enforcement bodies.
  3. There has been no court and judge specialized in IP. Thus, the most common approach is to file appeal application at the NOIP, the only Office in Vietnam having people specialized in IP.
